F-1, J-1 & H-1B: New Immigration Changes
F-1 & J-1 Students: Major D/S Changes Take Effect September 15
The new DHS rule takes effect September 15, replacing "duration of status" with fixed admission periods for F-1 and J-1 students and certain exchange visitors. The existing 60-day F-1 and 30-day J-1 grace periods remain, but the new rules change how extensions and certain status issues are handled.
DHS Proposes Ending the 60-Day Grace Period After Job Loss
DHS has proposed eliminating the 60-day grace period that currently allows H-1B and certain other employment-based visa holders to remain in the U.S. after their jobs end. If finalized, affected workers could face much less time to transition to another employer or immigration status.
New Public Charge Rules Take Effect September 18
USCIS is rescinding the 2022 public charge regulation, giving immigration officers broader discretion to consider relevant factors when determining whether someone is likely to become a public charge. The change will affect certain visa and adjustment-of-status applications filed on or after September 18.
